NOTICE OF PUBLIC HEARING ON ANNEXATION AGREEMENT AND REZONING

Notice is hereby given that the Village of Dieterich, Illinois, Board of Zoning Appeals and Planning, will hold a public hearing on November 26, 2018, at 6:00 P. M at the Village Hall, 109 North Main Street, Dieterich, Illinois, for the purpose of hearing arguments for and against an ordinance authorizing the execution of an annexation agreement in regards to the annexation to the Village of Dietrich of certain property legally described as follows:

Tract 1:

All that part of the following described real estate lying Northerly of State Highway 33:  Fifty-six and two-thirds (56 2/3) acres off of the North side of the West One-Third (1/3) of the South Half (S½) of Section Eleven (11), Township Seven (7) North, Range Seven (7) East of the Third Principal Meridian, EXCEPT the part conveyed to the Illinois and Indiana Rail Road Company by Warranty Deed recorded October 8, 1900 in Book 90 page 179 in the Recorder’s Office of Effingham County, Illinois; situated in the County of Effingham and State of Illinois (hereinafter referred to as “Tract 1”);

Tract 2:

The East Three Hundred Twenty feet (320’) of that part of the following described real estate that lies South of State Highway 33:  Fifty-six and two-thirds (56 2/3) acres off of the North side of the West One-Third (1/3) of the South Half (S½) of Section Eleven (11), Township Seven (7) North, Range Seven (7) East of the Third Principal Meridian, EXCEPT the part conveyed to the Illinois and Indiana Rail Road Company by Warranty Deed recorded October 8, 1900 in Book 90 page 179 in the Recorder’s Office of Effingham County, Illinois; situated in the County of Effingham and State of Illinois (hereinafter referred to as “Tract 2”); and,

Tract 3:

The South Half (S½) of the North Half (N½) of the Northwest Quarter (NW¼) of the Southeast Quarter (SE¼) and the South Half (S½) of the Northwest Quarter (NW¼) of the Southeast Quarter (SE¼) of Section Fourteen (14), Township Seven (7) North, Range Seven (7) East of the Third Principal Meridian, situated in the County of Effingham and State of Illinois (hereinafter referred to as “Tract 3”);

(Tract 1, Tract 2, and Tract 3 are hereinafter collectively referred to as the “Subject Property”).

It is proposed that Tract 1 of the Subject Property be zoned B-1, General Commercial District.  The form of the proposed Annexation Agreement is on file with the Village Clerk.

You are further notified that the proposed Annexation Agreement may be changed, altered, modified, amended, or redrafted in its entirety after the public hearing.

All interested parties are invited to attend the public hearing and will be given an opportunity to be heard.

Notice is hereby given that The Village of Dieterich, Illinois Board of Zoning Appeals and Planning will hold a public hearing on November 26, 2018 at 6:00 p.m., at the Village Hall, 109 North Main Street, Dieterich, Illinois for the purpose of considering a Petition for Variance requesting variance for North Front Yard Set Back from the required 20 feet in a B-1, General Commercial District, down to 8 feet, regarding the properties legally described as follows:

Part of Lot 4 and Lot 5 of Krabbe and Schultz Subdivision (Lot 1 Krueger’s 2nd Addition), reference made to Book 29, page 428, as recorded in the Effingham County Recorder’s Office, Effingham County, Illinois, being more particularly described as follows:
