NOTICE OF PUBLIC HEARING

 Notice is hereby given that the Village of Dieterich, Illinois, Board of Zoning Appeals and Planning will hold a Public Hearing on September 14, 2023, at 6:00 P.M. at the Village Hall, 103 W. Section Street, Dieterich, Illinois, for the purpose of hearing argument for and against the following matter:

Petition for Variance requesting a variance to reduce the minimum setback requirements from the required 25 feet in a B-1, General Commercial District, down to 0.00 feet or less, and allow for the walk in cooler and grease traps to be located adjacent to or within the alleyway, regarding the property legally described as follows:

Lots One (1) and Two (2) in Block Two (2) of KRUEGER’S SECOND ADDITION TO DIETERICH (reference made to plat thereof recorded in Plat Book 29 page 223, in the Recorder’s Office of Effingham County) EXCEPT that part thereof conveyed to the People of the State of Illinois, Department of Transportation by deed recorded on May 24, 1989 in Book 860 page 218, more particularly described as follows:  Commencing at a brass monument at the Southeast corner of Section Eleven (11), Township Seven (7) North, Range Seven (7) East of the Third Principal Meridian, Effingham County, Illinois; thence on an assumed bearing North 00° 00’ 00” West along the East line of said Section Eleven (11) a distance of 527.55 feet to the centerline of Federal Aid Route 95 (State Bond Issue 33); thence North 75° 49’ 18” West along said centerline a distance of 37.94 feet; thence Westerly a distance of 285.02 feet along said centerline, being a curve concave to the South and tangent with the last described line, said curve has a radius of 1145.93 feet, central angle 14° 15’ 03” and the chord of said curve bears North 82° 56’ 50” West; thence South 89° 55’ 39” West along said centerline, being tangent with the last described curve a distance of 77.08 feet; thence North 00° 00’ 00” West a distance of 25.00 feet to the Point of Beginning, being the Southeast corner (SE/c) of Lot One (1) in Block Two (2) of said Krueger’s Second Addition; thence South 89° 55’ 39” West a distance of 101.07 feet along the South line of the Southwest corner (SW/c) of Lot Two (2) of said Krueger’s Second Addition; thence North 00° 00’ 00” West a distance of 5.00 feet along the West line of said Lot Two (2); thence North 89° 55’ 39” East a distance of 76.07 feet; thence North 58° 58’ 58” East a distance of 29.17 feet to the East line of said Lot One (1); thence South 00° 00’ 00” East a distance of 20.00 feet along said East line to the Point of Beginning; situated in the County of Effingham and State of Illinois.

Lots Three (3) and Four (4) in Block Two (2) in KRUGER’S SECOND ADDITION TO THE VILLAGE OF DIETERICH (reference made to plat recorded in Plat Book 29 page 223 in the Recorder’s Office of Effingham County), EXCEPTING THEREFROM that part thereof conveyed to the State of Illinois, Department of Transportation, by Warranty Deed dated April 4, 1989, filed for record May 20, 1989, and recorded in Book 861 page 50 in the Office of the Recorder of Effingham County, Illinois, situated in the County of Effingham and State of Illinois,

ALSO KNOWN AS: Lots Three (3) and Four (4) in Block Two (2) in KRUGER’S SECOND ADDITION TO DIETERICH (reference made to plat recorded in Plat Book 29 page 223 in the Recorder’s Office of Effingham County), EXCEPTING THEREFROM that part thereof conveyed to the State of Illinois, Department of Transportation, by Warranty Deed dated April 4, 1989, filed for record May 20, 1989, and recorded in Book 861 page 50 in the Office of the Recorder of Effingham County, Illinois, situated in the County of Effingham and State of Illinois.
